Changes to H1-B Work Visas
The Biden administration’s proposed regulatory changes indicate that it will continue to reform the H-1B visa program for skilled professionals, including raising their salaries requirement.

However, aiming to tinker with the H1-B visa program will not solve the problem. According to the U.S. Census Bureau, the nation’s population growth hit a record low in 2021, barely moving at all during the 12 months ending July 1.

Canada, on the other hand, has increased its immigration intake year after year, from around 250,000 in a few years ago to approximately 300,000 last year and 411,000 projected immigrants in 2022. To stay competitive, the United States will need to significantly increase its immigration intake, especially with regard to foreign skilled workers.

The USCIS pledges that the petition will be completed within 15 days, with a refund of the petitioner’s filing fee if this is not possible. This service is expected to grow in 2022.

In September 2020, a federal court blocked an attempt to raise USCIS fees for various immigration applications. The Department of State is, however, expected to raise visa application filing fees at consulates in early 2022 as the USCIS is not operating on a solid financial foundation and requires additional resources to process backlogged applications.

Speeding up Visa Processing
As the epidemic recedes, consulates will reopen and likely to double down on visa processing, adopting strategies to catch up on queues. Efficiency in processing, including more online video interviews, will be a major focus.

In 2022, the Foreign Investor Fairness Protection Act will be introduced in Congress to protect foreign investors who invested in the regional center EB-5 program. These individuals will be allowed to stay because of the bill, which will grandfather them in and allow them to acquire green cards
